Acceptance of Terms

By accessing or using any website, portal, form, or application operated by Massive Mango LLC (“Massive Mango,” “we,” “us,” or “our”), you (“User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

Modifications

We may revise these Terms at any time by posting an updated version and changing the “Last updated” date. Continued use after changes take effect constitutes acceptance of the revised Terms.

Our Services

Massive Mango provides:

Web & application development, design, and digital consulting
Retainer packages (e.g., “unlimited edits,” SEO, email marketing)
Client portals, ticket systems, and AI-powered intake tools

Service details may change, be suspended, or be discontinued at any time without liability.

Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering a contract. You are responsible for safeguarding login credentials and for all activities under your account.

Prohibited Conduct

You agree not to:

Violate any law or third-party right.
Upload malicious code or attempt unauthorized access.
Resell, frame, or mirror the Services without written permission.
Submit content that is defamatory, obscene, or infringing.
Abuse any “unlimited” feature—reasonable-use limits apply, and we may throttle or refuse excessive requests.

Fees, Billing & Refunds

Prices are in U.S. dollars and exclude applicable taxes.
Retainer fees are billed in advance on a recurring monthly basis via Stripe or another processor.
Hourly overages are billed at the rate specified in your signed proposal.
Late payments may incur a 1.5 % monthly finance charge (or the maximum allowed by law).
All fees are non-refundable unless stated otherwise in a signed agreement.

Intellectual Property

We own all rights, title, and interest in the Services (software, logos, content) except content you supply.
Subject to full payment, project deliverables are assigned to you as outlined in your Statement of Work (SOW).
We retain a non-exclusive licence to display work in portfolios and marketing.

User Content

You grant Massive Mango a worldwide, royalty-free licence to host, display, and process content you upload solely to operate and improve the Services. You represent that you have all rights needed and that your content does not infringe third-party rights.

Third-Party Services & Links

Our sites may embed or link to third-party platforms (e.g., Webflow, HubSpot, formless.ai, Google Maps). We are not responsible for their content, availability, or privacy practices.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MASSIVE MANGO AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY CALENDAR YEAR WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THAT YEAR.

Indemnification

You will indemnify and hold harmless Massive Mango and its affiliates from any claim, loss, liability, or expense (including attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party right.

Termination

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or engage in conduct we deem harmful. Sections covering Intellectual Property, User Content, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and the Territory of Guam, without regard to conflict-of-law rules. Any dispute will be resolved by binding arbitration in Guam under the Commercial Arbitration Rules of the American Arbitration Association. Each party waives the right to court proceedings or class actions. Judgment on an award may be entered in any competent court.

Export Compliance

You agree to comply with U.S. export-control laws and not export or re-export any software or data from the Services to restricted territories or entities.

Entire Agreement

These Terms, the Privacy Policy, and any signed Statement of Work constitute the entire agreement between you and Massive Mango and supersede all prior or contemporaneous communications.
